For many people, pets are more than companions—they’re family. They provide unconditional love, daily comfort, and a deep sense of connection. But when it comes to estate planning, pets are often unintentionally left out.

Why You Need a Plan for Your Pet

Without a clear plan in place, your pet’s future may be uncertain. If something unexpected happens—whether a sudden illness, accident, or death—your pet could end up with someone you wouldn’t have chosen… or worse, in a shelter.

Planning ahead means:

  • Your pet will have a safe, loving home
  • Your chosen caregiver knows exactly what to do
  • Funds can be set aside for vet care, food, and other needs
You maintain control over how your pet is treated, even if you’re not there

Options for Including Pets in Your Estate Plan

Here are a few ways to legally protect your pets through estate planning in Washington State:

✅ 1. Include a Pet Care Directive in Your Will or Trust

While a will cannot leave money directly to a pet (animals are considered personal property under the law), you can use your will or trust to name a caregiver and leave them funds with instructions. With a living trust, you can provide the instructions for care while you are alive but incapacitated as well. Just remember: a will may go through probate, so if you choose this option it could delay access to those instructions or funds.

✅ 2. Create a Pet Trust

A Pet Trust is a more comprehensive option that allows you to:

  • Appoint a caregiver and a trustee (to manage funds)
  • Set aside money specifically for your pet’s lifetime care
  • Provide detailed instructions for feeding, medical needs, routines, and more
  • Ensure legal enforcement so your wishes are followed

In Washington State, pet trusts are legally recognized and can remain in effect until your pet passes away—even if that’s years later.  A pet trust can be done as a separate trust or part of a revocable living trust or part of your will.

✅ 3. Leave a Letter of Intent

While not a legally binding document, a Letter of Intent can accompany your estate plan and provide additional guidance, such as:

  • Your pet’s habits, food preferences, medications
  • Names of veterinarians or groomers
  • Special routines or comfort items
  • Emergency contacts

This helps your chosen caregiver provide continuity and comfort.

What to Consider When Choosing a Pet Caregiver

Not everyone is equipped—or willing—to care for your pet the way you do. Be sure to:

  • Talk with your chosen caregiver in advance
  • Consider naming an alternate in case your first choice is unable or unwilling
  • Make sure they understand your pet’s needs and your expectations

Discuss funding—especially if your pet has medical conditions or long-term care needs
